1. About These Terms

These terms and conditions govern the provision of web design, digital, and related services by K.T Designs to its clients. By engaging K.T Designs and confirming an order, you agree to these terms. Please read them carefully before proceeding.

2. Services

K.T Designs provides web design, web development, branding, print design, Google Business Profile setup, and related digital services to small businesses and tradespeople across the United Kingdom.

The specific scope of work, deliverables, and any agreed timelines will be confirmed in writing prior to commencement. Any material changes to the agreed scope must be agreed in writing by both parties.

3. Fees and Payment

All fees are agreed in advance and confirmed in writing before work begins. Prices are quoted in pounds sterling (GBP) and are exclusive of VAT unless otherwise stated.

A deposit may be required before commencement of work. The balance is due upon completion and prior to the website going live, unless otherwise agreed. Late payment may result in work being paused or withheld until payment is received.

K.T Designs reserves the right to charge statutory interest on overdue invoices under the Late Payment of Commercial Debts (Interest) Act 1998.

4. Client Responsibilities

To enable K.T Designs to deliver work on time and to the agreed standard, you agree to:

  • Provide all required content, images, copy, and materials in a timely manner
  • Provide clear and timely feedback during the review process
  • Ensure that any content you supply does not infringe third-party intellectual property rights
  • Nominate a single point of contact with authority to approve work

Delays caused by late provision of materials or feedback may affect agreed timelines and K.T Designs accepts no liability for such delays.

5. Intellectual Property

Upon receipt of full payment, ownership of the final deliverables (website files, logo, and other agreed assets) transfers to you, the client. You will own your website outright.

K.T Designs retains the right to display completed work in its portfolio and for promotional purposes unless you expressly request otherwise in writing.

Any third-party assets used (fonts, stock images, plugins) remain subject to their respective licences. K.T Designs will advise you of any such assets and their licence conditions.

6. Revisions and Amendments

Each project includes a reasonable number of revisions as agreed at the outset. Revisions are defined as minor changes to agreed work and do not include changes to the scope or direction of the project.

Additional revision rounds or scope changes may be subject to additional fees, which will be agreed in writing before work proceeds.

7. Timelines and Delivery

K.T Designs will make every reasonable effort to meet agreed timelines. Timelines are estimates and are dependent on timely receipt of content and feedback from the client. K.T Designs accepts no liability for delays caused by factors outside its reasonable control.

8. Limitation of Liability

K.T Designs will perform all services with reasonable skill and care. However, to the fullest extent permitted by law, K.T Designs shall not be liable for:

  • Any loss of profits, revenue, or business opportunity
  • Any indirect or consequential loss arising from the services provided
  • Any downtime, data loss, or technical issues caused by third-party hosting providers
  • Any errors in content supplied by the client

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any other matter that cannot be excluded by law.

9. Cancellation

Either party may cancel a project by providing written notice. If you cancel after work has commenced, you remain liable for payment for all work completed up to the point of cancellation. Any deposit paid is non-refundable unless K.T Designs has failed to commence the agreed work.

10. Confidentiality

Both parties agree to keep confidential any sensitive business information shared during the course of the engagement and not to disclose it to any third party without prior written consent, except where required by law.

11. Governing Law

These terms and conditions are governed by the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

12. Changes to These Terms

K.T Designs reserves the right to update these terms from time to time. The version in force at the time of your engagement applies to that project. Updated terms will be published on this website.
